Swan Valley Statutory Planning Committee
This committee undertakes the statutory planning functions of the WAPC for the Swan Valley area including maintaining and implementing the Swan Valley Planning Scheme No. 1 and determining subdivision and development applications within the area that support tourism and hospitality while protecting the agricultural and viticulture activities in the region. The SVSPC comprises members of the Statutory Planning Committee as well as representatives of the Swan Valley community, businesses and local government. The committee is established under Schedule 2 of the Planning and Development Act 2005 and operates in accordance with Part 4 of the Swan Valley Planning Act 2020.
Functions of Swan Valley Statutory Planning Committee
- The Swan Valley Statutory Planning Committee has the function of exercising the powers or duties delegated to it under subsection (2).
- The Commission may, by resolution, delegate to the Swan Valley Statutory Planning Committee any power or duty of the Commission under the Planning and Development Act 2005, another provision of this Act or another written law.
- The Commission must ensure that the following are delegated to the Swan Valley Statutory Planning Committee under subsection (2) —
- the functions of the Commission under Part 2 of this Act;
- the functions that the Commission has under the Planning and Development Act 2005 as the responsible authority for the Swan Valley Planning Scheme;
- the functions of the Commission under the Swan and Canning Rivers Management Act 2006 Parts 4 and 5;
- substantially the same functions of the Commission under the Planning and Development Act 2005 as are delegated to the Statutory Planning Committee established under the Planning and Development Act 2005 Schedule 2 clause 4, but only to the extent that those functions relate to land and development in the Swan Valley.
- The Commission must not delegate a function referred to in subsection (3)(a) to (c) to another person or body under the Planning and Development Act 2005 section 16(1).
